FSO Article 17 Audits

Owner occupiers of buildings have a legal requirement and responsibility to comply with Article 17 of the Regulatory Reform (Fire Safety) Order, which states that:

“Where necessary in order to safeguard the safety of relevant persons the responsible person must ensure that the premises and any facilities, equipment and devices provided in respect of the premises under this Order …. are subject to a suitable system of maintenance and are maintained in an efficient state, in efficient working order and in good repair”

This is reinforced by Article 38, which imposes a legal requirement to protect fire fighters and ‘post Grenfell Tower’ it is likely that Fire & Rescue and other enforcing authority will police the extent to which these legislative requirements are being observed. Similarly it is likely that other stakeholders such as tenants in HMO’s will want evidence of effective Article 17 compliance; an audit that can be communicated, shared and reviewed by others and potentially included as part of a formal agreement with employees, tenants and others can be seen as a positive, proactive measure.
